Virginia DUI penalties are severe, even for first time offenders. If convicted, the law requires ignition interlock, mandatory loss of your license, and other consequences.

Recently I had the opportunity to represent someone in Petersburg for a DUI with a BAC of .12. At .15 jail time is mandatory. So this was a pretty serious charge.

However, after some successful negotiating with the prosecutor the charge is to be amended to reckless driving with no active or suspended jail sentence, no license suspension, and just a fine. Past results do not guarantee or predict future results and cases depend on a variety of factors unique to each case.
